Loan agreement and borrower rights

Tying (sprzedaż wiązana): meaning in a Polish mortgage

In Polish: Sprzedaż wiązana
This is the word you will see in bank documents.

Definition

Tying (sprzedaż wiązana) means offering a loan only together with another product, when the loan cannot be obtained without that product. The Polish Mortgage Credit Act (Article 9) prohibits it, with exceptions described in the Act. Bundling (sprzedaż łączona) is allowed: the loan is also available separately and the package gives better terms.

What it means for you

The bank cannot force you to open an account with your salary paid in or to buy life insurance in order to get a mortgage. It can, however, offer better terms if you choose those products. If the bank makes the loan conditional on a product the Act does not allow, you can file a complaint and turn to the Financial Ombudsman (Rzecznik Finansowy) or the competition and consumer authority (UOKiK).
