Loan agreement and borrower rights

Mortgage loan agreement: meaning in a Polish mortgage

In Polish: Umowa kredytu hipotecznego
This is the word you will see in bank documents.

Definition

A mortgage loan agreement is a contract in which the bank makes a specified amount available to you for an agreed purpose, and you undertake to repay it with interest on set dates (Article 69 of the Polish Banking Law). It must be in writing. The Mortgage Credit Act adds a list of mandatory elements, including all fees, the total cost, and the rules for early repayment and withdrawal.

What it means for you

The agreement's clauses decide how much you pay over 20–30 years, not only at the start. Most surprises come from promotional margin conditions which, if not met, raise the instalment until the end of the loan. The bank must propose the draft agreement together with the loan decision, so you have time to read it before signing. Agreements are in Polish; have a translation or an expert explain the key clauses.

Frequently asked questions

Must the bank give me a draft loan agreement before signing?

Yes. The Mortgage Credit Act requires the bank to propose a draft agreement together with the loan decision, on its terms.

Can a mortgage agreement be negotiated?

The template usually not, but the margin, commission, promotional conditions and document deadlines often yes, especially with a second loan decision in hand. Ask for what you agree to be written into the agreement.

Is the loan agreement signed before a notary?

No. You sign the loan agreement at the bank or remotely. Before the notary you sign the purchase deed and the creation of the mortgage.
