Submission to enforcement: meaning in a Polish mortgage

In Polish: Oświadczenie o poddaniu się egzekucji
This is the word you will see in bank documents.

Definition

A submission to enforcement (oświadczenie o poddaniu się egzekucji) is a debtor's statement made in a notarial deed that, if the debt is not repaid, the creditor may enforce it without a prior court case (Article 777 § 1 points 4–6 of the Polish Code of Civil Procedure). Such a deed is an enforcement title to which the court grants an enforceability clause. Some banks require it for a mortgage, often in the property purchase deed.

What it means for you

If you stop paying and the bank terminates the agreement, it can send the case to a bailiff more quickly, because it skips the court case for payment. The amount in the statement is an upper limit, not the debt to pay: the bank may enforce only what is actually due. If you pay on time, the statement changes nothing.

Frequently asked questions

Must I sign a submission to enforcement?

There is no general statutory obligation, but if the bank requires it in the decision, you will not get the loan from that bank without it. Requirements depend on the bank.

Can the bank send a bailiff straight away?

No. It must first demand payment, allow restructuring, terminate the agreement and obtain an enforceability clause from the court.

Is the amount in the statement my debt?

No. It is the upper limit up to which the bank may enforce. It may enforce only the amount actually due.
