Notarial deed: meaning in a Polish mortgage

In Polish: Akt notarialny
This is the word you will see in bank documents.

Definition

A notarial deed (akt notarialny) is an official document drawn up by a notary in which the parties make declarations of will, e.g. conclude a property sale agreement. Transferring ownership of real estate in Poland requires the form of a notarial deed. When buying with a mortgage, the same deed usually creates the mortgage for the bank, and the notary files the applications to the land register.

What it means for you

On the day of the deed you must have in your account not only the down payment but also money for the notary fee, PCC tax and court fees, because banks usually do not finance them. The bank pays out the loan only after the deed, on the basis of its copy and a payout instruction. The deed must match the loan agreement, e.g. on the mortgage amount and how the price is paid. If you do not speak Polish, a sworn interpreter must take part in the deed, unless the notary speaks your language.

Frequently asked questions

Is the notarial deed signed before or after the loan agreement?

Usually after. You first sign the loan agreement, because the deed creates the mortgage for the bank, and the bank pays the money after the deed.

Can notary costs be paid from the loan?

Usually not. You pay the notary fee, PCC and court fees from your own money on the day of the deed. Some banks allow a larger loan, but then the LTV rises.

How much does the notarial deed cost when buying a flat?

It depends on the price and mortgage amount. The fee, copies and court fees usually come to several thousand złoty. On the secondary market add PCC of 2% of the price, e.g. PLN 10,000 for a PLN 500,000 flat, unless you are buying your first home.
