Loan decision: meaning in a Polish mortgage

In Polish: Decyzja kredytowa
This is the word you will see in bank documents.

Definition

A loan decision (decyzja kredytowa) is the bank's answer to a mortgage application, setting the amount, term, interest rate, security and payout conditions. Under the Polish Mortgage Credit Act it is an offer within the meaning of the Civil Code and binds the bank for at least 14 days from delivery. Together with the decision, the bank proposes a draft agreement on its terms.

What it means for you

A positive decision does not yet mean money: you still have to sign the agreement and meet the payout conditions. While the offer is binding, the bank may not change the terms for the worse or demand a final answer from you. If you have decisions from two banks, you can compare them calmly and accept only one.

Frequently asked questions

How long is a loan decision valid?

By law at least 14 days from delivery. Banks usually give 30–90 days; the exact period is stated in the decision.

Can I decline a positive loan decision?

Yes. The decision is the bank's offer. If you do not accept it, you bear no costs other than fees charged earlier, e.g. for the valuation.

Can the bank withdraw a loan decision?

While the offer is binding, it may not worsen the terms. It may, however, refuse the payout if your situation changes significantly before it or you do not meet the conditions of the agreement.
