Blank promissory note (weksel in blanco): meaning in a Polish mortgage

In Polish: Weksel in blanco
This is the word you will see in bank documents.

Definition

A blank promissory note (weksel in blanco) is an incomplete note: you sign it, but without the amount or due date filled in. If you do not repay the loan, the bank may complete it according to the promissory note declaration (deklaracja wekslowa). If the note is completed contrary to that agreement, you cannot rely on this against a holder who acquired it in good faith (Article 10 of the Polish Bills of Exchange Act).

What it means for you

For mortgages banks usually do not require a promissory note, because the mortgage is the security. You will see it more often with business loans, leasing and some personal loans. If the bank requires one, read the declaration: up to what amount and in which situations the bank may complete the note. A promissory note lets the creditor pursue payment in court faster.

Frequently asked questions

Is a blank promissory note safe?

The risk is small if the declaration clearly limits the amount and the situations in which the bank may complete it, and you repay on time. Problems arise with arrears.

Can I refuse to sign a promissory note?

Yes, but the bank may then refuse the loan or propose other security. Ask about alternatives before applying.

How does a promissory note differ from a guarantee?

The note is usually signed by the borrower, while a guarantee is given by a third party. There is also a guarantee on the note itself (aval), where another person signs the note (Article 30 of the Bills of Exchange Act).
