In Polish: Rozdzielność majątkowa
This is the word you will see in bank documents.
Definition
Separate property (rozdzielność majątkowa) is a marital regime in which each spouse has their own assets and is liable for their own debts. It is created by a property agreement signed before a notary, commonly called intercyza, before or during the marriage, or by a court judgment. Without such an agreement, joint marital property applies from the wedding.
What it means for you
With separate property you can buy a flat and take a mortgage alone, without your spouse's consent or participation. It does not increase your creditworthiness, because the bank still counts the living costs of the whole household. A property agreement signed after taking the loan does not release the other spouse from the debt.

Frequently asked questions
With separate property, does my spouse have to be on the mortgage?
No. With separate property one spouse can buy a flat and take a mortgage alone, without the other's consent. The bank will still ask about the household.
Does a property agreement increase creditworthiness?
No. The bank counts the living costs of the whole family and will not add the other spouse's income. A joint application usually gives a higher amount.
Does a property agreement signed after the loan release my spouse from the debt?
No. Both borrowers are jointly liable until the loan is repaid, unless the bank agrees to an annex releasing one of them.
